1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of reaperman.com and its related pages and features, including the Reaper Man Arcade, games, high-score leaderboards, email signup, embedded media, and online store (together, the "Site"). The Site is operated by Ryan Lee McDaniel, doing business as Reaper Man ("Reaper Man," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. How Our Terms Fit Together

These Terms cover general use of the Site. Purchases of merchandise, digital products and, in the future, skateboards are also covered by our Terms and Conditions and our Shipping and Returns policy. Our Privacy Policy explains how we handle information. If these Terms and the Terms and Conditions conflict on anything about a purchase, the Terms and Conditions apply.

3. Eligibility and Supervision

You must be able to legally agree to these Terms to use the Site. The Site is not directed to children under 13. If you are under the age of majority where you live, use the Site with permission and supervision from a parent or legal guardian. Parents and guardians are responsible for supervising minors' use of the Site and any purchases or information they submit.

4. Acceptable Use

Use the Site lawfully and respectfully. You may not: (a) break applicable laws or regulations; (b) interfere with the Site's operation, security, or availability; (c) attempt to access non-public systems, admin tools, or accounts without authorization; (d) introduce malware, spam, or harmful code; (e) exploit bugs, send fake or manipulated scores, use bots or cheats, or interfere with fair arcade play; (f) impersonate another person or submit misleading information; (g) use the Site to harass, threaten, defame, or violate another person's rights; or (h) copy, scrape, or reuse Site content in a way that violates law or these Terms.

5. Arcade Games and High Scores

Games are provided for entertainment. Some games unlock while their music video is playing. Game availability, rules, scoring, saved progress, and leaderboards may change, reset, or become unavailable.

Each game has a public Top 10 leaderboard. If you choose to submit a score:

• Your display name and score are shown publicly to everyone who visits that game.
• Names can be up to 15 characters. Names with slurs, profanity, or insults or negativity aimed at Reaper Man or his music are not allowed and will be refused or removed.
• Do not use your real name, email address, phone number, or other private information as a player name.
• To stop spam, there are limits on how often scores can be sent.

We may remove scores, reset a leaderboard, restrict access, or disqualify entries that we reasonably believe involve cheating, automation, abuse, offensive names, or technical manipulation. We do not guarantee that scores or progress will be stored permanently or without error. Leaderboards do not come with prizes unless a specific promotion says so.

6. Intellectual Property

Unless otherwise stated, the Site and its original content, including Reaper Man branding, artwork, text, graphics, music, lyrics, videos, game concepts and code, and other materials, are owned by or licensed to Reaper Man and are protected by applicable intellectual-property laws. You may access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, sell, create derivative works from, or commercially exploit Site content without our prior written permission, except where applicable law allows it. Third-party names, logos, music, games, and services belong to their respective owners.

7. Music, Embedded Content, and Third-Party Services

The Site links to or embeds services such as Spotify, YouTube, Google Fonts, social networks, Shopify, and payment processors. These services are operated by third parties and have their own terms, privacy policies, availability rules, and account requirements. Your use of those services is governed by their terms. We do not control and are not responsible for third-party services, their content, or their practices. Embedded players may require a separate account, user action, or subscription and may change or stop working without notice.

8. Online Store, Orders, and Payments

The Site links to and provides access to a store powered by Shopify. Purchases are covered by our Terms and Conditions and Shipping and Returns policy, plus any terms shown at checkout. Payments are handled by the payment methods offered at checkout. We do not collect or store your full payment-card number.

9. Future Skateboard Company

Reaper Man is preparing to launch a skateboard brand. Until it launches, any skateboard pages are for information only, and nothing on them is an offer to sell. When skateboards go on sale, they will be covered by these Terms, our Terms and Conditions, and any product-specific terms, warnings, or safety information shown with them.

10. Email Signup and Communications

When our email list is live and you subscribe, we may send updates about music, releases, shows, merchandise, the arcade, and our skateboard brand. You can unsubscribe using the link in any marketing email or by contacting us. Transactional or service messages, such as messages about an order or your request, may still be sent when necessary.

11. Messages and Submissions

If you send us a message, feedback, suggestion, or other content, you confirm that you have the right to provide it. Do not send confidential information you do not want us to receive. You allow us to use your submission as reasonably necessary to respond to you, operate the Site, and handle your request. We do not claim ownership of your original content just because you send it to us. We may remove public submissions, such as leaderboard names, or restrict their display where reasonably necessary to protect the Site, visitors, or our rights.

12. Privacy and Cookies

Our Privacy Policy explains how information is collected, used, and shared through the Site, including through on-device storage, embedded content, the arcade, email, and the online store. You can manage on-device storage on our Cookie Settings page. Disabling some technologies may affect Site features.

13. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis, to the extent permitted by law. We do not promise that the Site will always be available, secure, accurate, complete, error-free, compatible with every device, or free of harmful components. We may change, suspend, or discontinue any part of the Site at any time. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Reaper Man and those helping operate the Site will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or access arising from or related to your use of (or inability to use) the Site or third-party services. To the extent liability cannot be excluded, it will be limited as permitted by applicable law. These Terms do not limit liability that cannot legally be limited.

15. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights. This section does not apply to the extent a claim results from our own conduct where applicable law prohibits such an allocation.

16. Suspension and Termination

We may suspend or restrict access to all or part of the Site if we reasonably believe you have violated these Terms, compromised Site security, manipulated games or scores, or created a risk for the Site or its visitors. You may stop using the Site at any time. Terms that by their nature should continue after use ends, including intellectual-property provisions, disclaimers, limitations of liability, and dispute-related provisions, will survive to the extent permitted by law.

17. Changes to the Site or These Terms

We may update the Site and these Terms from time to time. We will post the updated version on this page and change the effective date. Changes apply from the posted effective date unless applicable law requires otherwise. Your continued use of the Site after updated Terms are posted means you accept them, to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules, except where mandatory consumer-protection laws require otherwise. Any dispute will be handled in a court with proper jurisdiction, subject to any rights you have under applicable law.
